1. Who we are

This website, sharkskineurope.com (the "Site"), is operated by SHARKSKIN BULGARIA LTD ("we", "us", "our"), the European distributor of Sharkskin technical water-wear.

These Terms of Service ("Terms") govern your use of the Site and any purchase you make through it. By placing an order you confirm that you accept these Terms.

2. Our products

We sell technical thermal and protective water-wear and related watersports and diving equipment. Product descriptions, images and specifications are provided in good faith; minor variations in colour or appearance may occur.

3. Prices

All prices are shown in euro (EUR) and include Bulgarian VAT where applicable. Shipping costs, if any, are shown before you confirm your order. We may change prices at any time, but changes do not affect orders we have already accepted.

4. Orders and formation of the contract

Your order is an offer to buy. After you order, we send an acknowledgement email; this confirms we have received your order but does not by itself form a contract. The contract is formed when we send you an email confirming that the goods have been dispatched. If we cannot fulfil an order (for example, an item is out of stock or mispriced), we will tell you and refund any payment taken.

5. Payment

Payment is taken through the payment methods shown at checkout. All payments are processed by our payment providers over secure connections; we do not store your full card details.

6. Delivery

We ship within the European Union and, where offered, worldwide. Delivery times shown at checkout are estimates. Risk in the goods passes to you on delivery. Because we ship from within the EU, deliveries within the EU are not subject to customs duties; for deliveries outside the EU, any import duties or local taxes are your responsibility.

7. Your right of withdrawal (14 days)

If you are a consumer in the EU, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you (or a third party indicated by you) acquire physical possession of the goods (or the last item, for a multi-item order).

To exercise this right, tell us of your decision by a clear statement (for example, an email to contact@sharkskineurope.com) before the period expires. You may use the model withdrawal form below, but it is not obligatory.

Effects of withdrawal. We will reimburse all payments received from you, including standard delivery costs, without undue delay and no later than 14 days after we are informed of your decision. We may withhold reimbursement until we have received the goods back or you have supplied evidence of return, whichever is earlier. You must send the goods back without undue delay and no later than 14 days after informing us; you bear the direct cost of returning the goods. You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning. For hygiene reasons, sealed items are not eligible for return once unsealed.

8. Returns, refunds and exchanges

Beyond the statutory right of withdrawal above, please see our Refund policy and our Returns, Exchanges & Warranties page for how to return or exchange an item. Refunds are made to your original payment method.

9. Legal guarantee of conformity

As a consumer you benefit from the statutory guarantee that goods conform to the contract. If goods are defective or not as described, you are entitled to the remedies provided by applicable EU and Bulgarian consumer law (repair, replacement, price reduction or refund) for a period of at least two years from delivery. This is in addition to any commercial warranty offered by the manufacturer.

10. Intellectual property

All content on the Site (text, images, logos and the Sharkskin marks) is protected and may not be copied or used without permission.

11. Liability

Nothing in these Terms limits our liability where it would be unlawful to do so (including liability for death or personal injury caused by our negligence, or for fraud). Otherwise, we are not liable for losses that were not foreseeable, or for business losses. Your statutory rights as a consumer are not affected.

12. Privacy

We process your personal data in accordance with our Privacy policy and the EU General Data Protection Regulation (GDPR).

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Bulgaria, without affecting the mandatory consumer-protection rights you enjoy in your country of residence. Disputes may be brought before the competent Bulgarian courts.
